1. Binding Agreement and Scope
By executing a booking through the IZI Transfer website, API, or affiliate partners, the Client enters into a legally binding contract with IZI Transfer (Registration Number: KZ63UWQ06967439, Astana, Kazakhstan). These Terms and Conditions strictly govern the liabilities, obligations, and service level agreements associated with all provided transportation services.
2. Booking Validation and Payment Authorization
A booking is exclusively deemed valid upon the issuance of a digital confirmation receipt by IZI Transfer. The Client authorizes IZI Transfer to place a temporary hold or process a full charge on the provided payment method at the time of booking. Falsification of payment details or passenger identity will result in immediate termination of service and potential reporting to fraud prevention agencies.
3. Service Execution and Operator Obligations
- Vehicle Compliance: IZI Transfer guarantees that all dispatched vehicles will meet or exceed the selected tier (Standard, Business, Minivan) and possess all necessary local operational licenses and commercial passenger insurance.
- Driver Conduct: Chauffeurs will be professionally attired, possess valid commercial driving credentials, and adhere to all local traffic safety laws.
- Route Optimization: The chauffeur reserves the right to deviate from standard GPS routing to ensure passenger safety and timeliness due to unforeseen traffic or road hazards.
4. Passenger Code of Conduct and Liabilities
The safety and condition of our fleet are paramount. Passengers strictly agree to the following:
- No consumption of alcohol, smoking, or use of illicit substances within the vehicle under any circumstances.
- The passenger assumes full financial liability for any interior damage, excessive soiling, or vandalism. IZI Transfer reserves the right to automatically charge the payment method on file a minimum $150 USD cleaning/repair fee, plus actual damages.
- Aggressive, abusive, or threatening behavior towards the chauffeur will result in the immediate termination of the ride mid-route, without refund, and potential law enforcement intervention.
5. Limitation of Liability and Force Majeure
IZI Transfer operates with the highest degree of reliability; however, we are not liable for circumstances entirely beyond our control. Force Majeure applies to, but is not limited to: severe meteorological events, unannounced road closures, acts of terrorism, civil unrest, or catastrophic mechanical failure not resulting from negligence.
In no event shall IZI Transfer, its directors, or affiliates be liable for indirect, punitive, incidental, or consequential damages (including missed flights, lost business opportunities, or hotel cancellation fees). The absolute maximum financial liability of IZI Transfer for any claim related to a specific booking shall never exceed the total monetary value paid by the Client for that specific booking.
6. Governing Law and Arbitration
These Terms and Conditions shall be exclusively governed by, and construed in accordance with, the laws of the Republic of Kazakhstan. Any dispute, controversy, or claim arising out of or relating to this contract shall be settled by binding arbitration in Astana, Kazakhstan, conducted in the English or Russian language.
